Welcome to Benevolence Labs. By accessing or using our websites (lactcheck.benevolencelabs.com, diginoise.benevolencelabs.com) or our DigiNoise application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

1. Description of Service

LactCheck is a free tool that provides information about medication safety during breastfeeding. It is intended to help users research medication options, not to replace professional medical advice.

DigiNoise is a desktop application that generates digital noise to protect user privacy by obscuring online profiles.

Both services are provided free of charge, open-source, and without warranty.

2. Not Medical Advice

IMPORTANT: LactCheck provides information about drugs and their potential transfer into breastmilk, but this is NOT medical advice.

  • We are not a healthcare provider
  • The information provided is for research purposes only
  • Always consult with a qualified healthcare provider (doctor, pharmacist, lactation consultant) before making decisions about medication while breastfeeding
  • Never disregard professional medical advice or delay seeking it because of something you found on our site

Use of LactCheck is at your own risk. The predictions and data provided may be inaccurate, incomplete, or outdated. You acknowledge that the information provided is not a substitute for professional medical judgment.

3. No Warranty

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • THE RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE
  • THE QUALITY OF ANY PRODUCTS, SERVICES, OR INFORMATION PURCHASED OR OBTAINED WILL MEET YOUR EXPECTATIONS

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENEVOLENCELABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR USE OR INABILITY TO USE THE SERVICES
  • ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN
  • ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICES

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED $100.

5. User Responsibilities

By using our services, you agree to:

  • Use the services only for lawful purposes
  • Not attempt to gain unauthorized access to any part of our services
  • Not interfere with or disrupt the integrity or performance of our services
  • Not introduce any viruses, worms, or other harmful code

The Benevolence Labs name, logo, and all related trademarks are owned by Benevolence Labs. Our projects are open-source under the MIT License—see individual repositories for details.

7. User-Generated Content

If you submit feedback, suggestions, or ideas about our services, you grant us the right to use, modify, and commercialize such content without compensation or attribution.

8. Indemnification

You agree to indemnify, defend, and hold harmless Benevolence Labs and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the services
  • Your violation of these Terms
  • Your violation of any third-party rights

We reserve the right to terminate or suspend your access to our services at any time, without prior notice, for any reason, including if we believe you have violated these Terms.

These Terms constitute the entire agreement between you and Benevolence Labs regarding our services and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.
